MediaGIANT. LICENSE AGREEMENT PLEASE READ THIS LICENSE AGREEMENT (“LICENSE”) CAREFULLY BEFORE USING THE MEDIAGIANT VIDEO MEDIA. BY USING THE MEDIAGIANT VIDEO MEDIA, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE MEDIAGIANT VIDEO MEDIA AND, IF PRESENTED WITH THE OPTION TO “AGREE” OR “DISAGREE” TO THE TERMS, CLICK “DISAGREE”. IF YOU DISAGREE WITH THE TERMS OF THE LICENSE, YOU MAY OBTAIN A REFUND, SUBJECT TO MEDIAGIANT’S RETURN POLICY.
IMPORTANT NOTE: To the extent that this media may be reproduced, modified, published or distributed, it is licensed to you only in the form that it has been rendered to you from MediaGIANT. If you are uncertain about your right to copy, modify, publish or distribute this licensed material, you should contact MediaGIANT.
1. License
A. You are granted a limited, non-exclusive license to embed and stream, use and run one (1) copy of the MediaGIANT video media at any one time.
B. Compliance with Laws. You agree to use the MediaGIANT video media and the Services in compliance with all applicable laws, including local laws of the country or region in which you reside or in which you download or steamed the video media and services. An Internet connection is required for MediaGIANT video content.
C. MediaGIANT and its affiliates, at its discretion, may make available future upgrades or updates to the streaming platform or media. The terms of this License will govern any upgrades or updates provided by MediaGIANT that replace and/or supplement the original MediaGIANT media product, unless such upgrade or update is accompanied by a separate license in which case the terms of that license will govern.
D. Intellectual property rights in and to any content displayed by or accessed through the MediaGIANT platform or video content belong to MediaGIANT. Such content may be protected by copyright or other intellectual property laws and treaties. Except as explicitly provided above, this License does not grant you any rights to use or modify such content.
2. Termination. This License is effective until terminated. Your rights under this License will terminate automatically or otherwise cease to be effective without notice from MediaGiant if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of the MediaGIANT video media and destroy all copies, full or partial, of the video media. Sections 1 and 2 of this License shall survive any such termination.
A. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE MEDIAGIANT VIDEO MEDIA IS AT YOUR SOLE RISK AND THAT YOU AS LICENSEE OR YOUR DESIGNEE HAS DONE DUE DILIGENCE TO ENSURE THAT THE PLATFORM YOU CHOOSE TO STREAM THE MEDIAGIANT VIDEO MEDIA IS SECURE AND WILL NOT SUFFER ANY ADVERSE AFFECTS DUE TO SOFTWARE CODE OR PLATFORM HOST SECURITY UPDATES OR ANY OTHER TECHNICAL MATTER. FURTHER, YOU CONFIRM THAT YOU HAVE RECENTLY BACKED UP THE PLATROM THAT YOU CHOOSE TO STREAM THE MEDIAGIANT VIDEO MEDIA WITH TO ENSURE THAT SHOULD ANY UNFORSEEN PROBLEMS ARISE, YOU WILL HAVE THE ABILITY TO REBOOT YOUR PLATFORM. THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU THE USER.
C. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MEDIAGIANT VIDEO MEDIA AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND MEDIAGIANT AND MEDIAGIANT’S PARTNERS (COLLECTIVELY REFERRED TO AS “MEDIAGIANT” FOR THE PURPOSES OF OTHER SECTIONS IN THIS AGREEMENT) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE MEDIAGIANT VIDEO MEDIA AND SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.
